This Privacy Policy describes how we use the Personal Data related to you when you use our services via the Omnistream mobile application (the “Mobile App”), or via our website located at www.omnistream.live (the “Web App”, and collectively the “App” and the “Services”).

In this Privacy Policy, “we,” “us,” and “our” refer to Omnistream Ltd. and all its subsidiaries.

We want you to fully understand what Personal Data we collect, how we use this Personal Data, and the steps we take to protect such Personal Data. We encourage you to read this Privacy Policy to learn more about the policies and procedures we have put in place to do just that.

You are not obliged to provide us with Personal Data related to you and if you do, it is willingly and with your consent. You agree, however, that without providing us with the Personal Data related to you, we cannot offer you the use of the Services or their full scope.

  1. The Personal Data that you provide us

When you download the App, register to the Services and use the Services, you provide us (and we process) the following Personal Data:

  • first name, maiden name, last name, username or similar identifier, password, email address, telephone number;
  • any other Personal Data that you choose to provide when contacting us;
  • any content you stream and view during your use of the Services, including the preferences you set, e. g. language preference, as well as photographs, audios and videos that you stream or upload;
  • Personal Data about the images and audios that are part of your content, for example through identifying the objects and scenery that appear in such content, details and location of an image of face and body features and attributes, nature of an audio, or text of words in your content.

When using our Services, we will request that you provide us with access to Personal Data derived from your device and during the use of the Services.

  • Location data:

During App installation, and during your use of the App, we will request you to allow us to access your device location. When you enable location-based functions through permission settings on your mobile device, we will collect and process your location information to enable certain functions in the App to operate.

  • Usage Data:

When you use our Services, we automatically collect information about your use, for example your device’s IP address and type, your camera type, your log-in and log-out time, how you engage with the Services, the ads you view, what videos you stream and view, the duration of your session and additional activity metrics.

We deduce your preferences, for example your interests, gender, and age for the purpose of personalizing your content.

  • to allow the use of the Services and the functions, tools and features of our App;

    • Aggregated data could be derived from Personal Data related to you but is not considered personal data in terms of the law, as this data will not directly or indirectly reveal your identity. For example, we may aggregate your and other Services’ users usage data to calculate the percentage of users accessing a specific feature.
    • However, if we combine or connect aggregated data with Personal Data related to you so that it can directly or indirectly identify you, we treat the combined data as Personal Data which will be used in accordance with this Privacy Policy.

    • We do not and will not sell Personal Data related to you.
    • We will share Personal Data related to you with others for a number of reasons such as: to comply with applicable laws and regulations; to protect your vital interests or the vital interests of another natural person; to protect our operations, business and systems; to protect our rights, privacy, safety or property, and/or that of other users, including you.

  • request us to correct, amend or delete Personal Data if you think the processing of said Personal Data is in violation of applicable law or if it appears inaccurate, incomplete or not up-to-date. If you provide us with the necessary data to correct it, we will make an effort to act upon your request.

Please note that we will redact Personal Data of others from the data which we will send to you.

 

  1. Data retention and deletion
    • We retain different types of Personal Data for different periods, depending on the purposes for processing the Personal Data, our legitimate business purposes and pursuant to legal requirements under the applicable law.
    • To the extent reasonable, we will delete or de-identify potentially identifiable data, when we no longer need to process the data on an identified basis. We will keep aggregated, non-identifiable data without limitation.
    • In any case, as long as you use the Services, we will keep Personal Data related to you, unless the law requires us to delete it.
    • If we need to delete Personal Data related to you, it will take some time until we completely delete residual copies of said Personal Data from our active servers and from our backup systems.

Omnistream and the Services are not intended to be used by children under the age of 13. In some territories, the age limit may be higher, contingent upon local requirements. If you believe that we have mistakenly collected Personal Data about a child under the respective age, please contact us immediately at info@omnistream.live and we will act to remove said Personal Data from our systems and from the Services.

    • We use physical, administrative, and technical procedures and measures designed to help prevent unauthorized access and maintain data security confidentiality.
    • Although we take appropriate measures to safeguard against unauthorized disclosures of Personal Data, we cannot assure you that Personal Data related to you will never be disclosed, altered, or destroyed in a manner that is inconsistent with this Privacy Policy.

    • where we rely on our legitimate interest for the processing of the Personal Data related to you, you will have the right to object to the processing of the Personal Data related to you;
    • you have the right not to be subject to a decision based solely on automated processing, for example profiling, which produces legal effects concerning you or similarly significantly affecting you;

The Owner takes appropriate security measures to prevent unauthorized access, disclosure, modification, or unauthorized destruction of the Data.
The Data processing is carried out using computers and/or IT enabled tools, following organizational procedures and modes strictly related to the purposes indicated. Retention time

Personal Data shall be processed and stored for as long as required by the purpose they have been collected for.

Therefore:

  • Personal Data collected for purposes related to the performance of a contract between the Owner and the User shall be retained until such contract has been fully performed.
  • Personal Data collected for the purposes of the Owner’s legitimate interests shall be retained as long as needed to fulfill such purposes. The Owner may be allowed to retain Personal Data for a longer period whenever the User has given consent to such processing, as long as such consent is not withdrawn. Furthermore, the Owner may be obliged to retain Personal Data for a longer period whenever required to do so for the performance of a legal obligation or upon order of an authority.

Once the retention period expires, Personal Data shall be deleted. Therefore, the right to access, the right to erasure, the right to rectification and the right to data portability cannot be enforced after expiration of the retention period.

Approximate location permission (non-continuous)

Used for accessing the User’s approximate device location. This Application may collect, use, and share User location Data in order to provide location-based services.
The geographic location of the User is determined in a manner that isn’t continuous. This means that it is impossible for this Application to derive the approximate position of the User on a continuous basis.

Camera permission

Used for accessing the camera or capturing images and video from the device.

Microphone permission

Used for accessing and recording microphone audio from the User’s device.

Phone permission

Used for accessing a host of typical features associated with telephony. This enables, for instance, read-only access to the “phone state”, which means it enables access to the phone number of the device, current mobile network information, or the status of any ongoing calls.

Precise location permission (continuous)

Used for accessing the User’s precise device location. This Application may collect, use, and share User location Data in order to provide location-based services.

Storage permission

Used for accessing shared external storage, including the reading and adding of any items.

The rights of Users
